One Of The Most Important Of Modern Laws...
ONE of the most important of modern lawsuits in connection with home copyright has just "been decided in the House of Lords .
Curiousl v ^ y enough it is a question which , through its apparent simplicity , ought to have
arisen and been settled long ago . But the simplicity is only in the public mind . The
busy bees that hum round the honelyed oaks of the Law Courts give very divergent views of
the matter . Its complications are too mtich for . them ; and there is every reason to believe
that public opinion , if it be directed to the subject at all , will be equally confused . The
judicial light supplied by the higher courts of Scotland and England is , in this instance , very
unsteady . ^ mr r w « r Briefly stated , the case was as follows : —
Dr . Caird , who is professor of Moral Philosophy in the University of Glasgow , delivers an
academic course of lectures . Are these lectures copyright ? It appears that they were
' reported' by one of the students , and subsequently condensed and printed in books
called * An Aid to the Study of Moral Philosophy , especially designed for Students of
Philosophy , ' followed by second and third series . The 'aids' were published by ] Mr .
Sime , bookseller , Glasgow , against whose action Professor Caird claimed an interdict . The
publisher said that his books were original ; £ ut one of the Sheriffs of Lanarkshire declared 4
them to be wholly or in substance reproductions [ of Dr . Caird ' s lectures ] , more or less
correct . ' This opinion fairly fregari the legal tussle , being the prelude to a course that is
much esteemed by Scottish lawyers as a * guid gangin' plea . ' We fear that our own limbs of
the law are not averse to the same process . The principal judges in Scotland reversed
the decision of the County Sheriff , and held that I Professor Caird ' s lectures couldin the form of
| notes , be published without sanction , ; but of
thirteen Scottish judges six expressed the con- I
trary opinion , namely , that the proTessor was I entitled to the usual privileges — of authorship . I
On appeal , the opinion of this minority has I been confirmed in the House of liords . Ijord I
Watson delivered judgment , and was supported by the Liord Chancellor . Lord Fitzgerald ,
who dissented , expressed the opinion that the reading of the lectures was a publication to the
public at large . The final judgment , declaring that a University lecturer is entitled to tangible
property in < his orations , leaves room for a considerable amount of discussion , and the
unusual division of opinion among our greatest judges is very significant in this respect .
While heartily sympathising with Mr . Sime , we cannot help thinking that a
University professor ought certainly to have a considerable interest in the printing of his
intramural lectures . They are by no means advancing public propert ^ science y , and are the in many result branches of original of
thought' and investigation . All professors , however , whose work is important . JL . should
publish simple notes as early as possible . We are aware of cases where these have been
delayed for years , much to the inconvenience of students , and to the disadvantage of learning .
As we have already said , we sympathise with Mr . Sime . He did good service by publishing
these notes , and it is —mr a pity that he ^ has b had to ^" suffer by passing through the expensive courts
of Scotland and England . While we believe in the sincerity of his convictions , we find it
difficult to conceive that professors can be
deprived of rights so apparent .
