There was a valva in the tube vrbicii would let the air in , and prevent it returning . Ou examining the wall more closely , a ttoiie appeared '« o have been recently inserted , as the mortar was damp and soft . Barker called Mr . Bottcmley , and he went down to examine the p ^ ace . On removing soma Ktones , they found the tin tube screwed on to some gas piping , which passed through a solid etone wall , and through the cistern into the condenser of the engine . The effect of the valve was to admit a current of air into the condenser , to destroy the vaccum , and thus considerably to diminish the power of the engine . The prisoner was employed by the prosecutor as his
engine-tenter , and had been so for two years , during which time be had conducted himself with much propriety . The prosecntor had at first given him 28 i . per week , but in consequence of some improvement which the prisoner had made in the engine with the con .-ent of hi 3 employer , 32 s . per week was given him . The prisoner had the sole superintendence of the engine ; be had the keys of the room , and no other person had any right there save him and his employer . On the morning of tho 27 th of April , the prisoner , instead of goiag to his work , wa 3 observed in his best clothes , leaving the neighbourhood , and was never seen again by the pro-ecutor till he had been apprehended . After the evidence for the prosecution had been adduced , Sir G . Lewin asked his Lordship whether h e tho-jght the evidence supported the indictment . Tbe learned Jddoe thought that in order to sustain ibis indictment , the engine should be employed in manufacturing and preparing woollen goods , without any mixture , and also of preparing and manufacturing cotton goods , that was to say , making entire warps . The engine was employed for neither of those purposes , and , therefore he , ( tho Judge ) thought the evidence did not sustain the indictment . The Jury , under his Lordships direction , found the prisoner Not Guilty , but we understand that another indictment will be preferred .

Woutley this morning stated to his LordBhip , that he was instructed to make a motion on behalf of the Attorney General , with reference to the cases of William Cockroft and other prisoners , who had been committed to York Cmst ! e for trial , since the commencement of these aaaizos , for offences connected with the disturbances v ; hich have lately prevolltd in this country . The motion which he bad to make to his Lordship was this—that these prisoners should remain upon their commitments until a special commission should be Usued . He made the motion upon the affidavit o' Mr . Maole , the solicitor to the treasury , from which it appeared that there were at that moment 111 prisoners ¦ who had been sent for trial for various offences which
had arisen since the commencement of the assizes ; and there were also fifty-six ethers in custody in York Castle , who had been sent there to await an examination on a future occision . The affidavit further stated that other prisoners -were likely to be committed , and that it was in contemplation to advise ner Majesty to issue a special commission for the trial of these offenders , as well as otbe . s charged with tbe liko offences , it was also sworn that there had not been sufficient time to consider the coses , and that only a sraull portion of the d-. positions taken before magistrates indifferent parts of the county , bad aa yet been transmitted to the Secretary of State , and that the officers of the Government who had instituted these prosecutions had not had nnd would nut have si . ffioient time , if this motion were not assented to , to prepare the prosecutions on the
various cases . Mr . Justice Maule ssid , that having sat for a fortnight , and with the probability of Bitting another fortnight , be had no wish to prolong tbe assizes ; but he did not think the affidavit sufficient to justify the ppplication , as it did not specify any particular prisoners , n * r did it state , except in a loose way , that other evidence ¦ was likely to be forthcoming , It merely stated that it was believed that important evidence might be expected , but it did not show the existenca of any grounds for expecting it . This amounted to nothing at all . Mr . WoitTLEY eaid , the affidavit alleged that there had not been « uffletent time to obtain eopies of all dtpositions , to peruse those which had been obtained , bo as to classify the cases , and to prepare the indictments necessary to prosecute the several prisoners .
Mr . Justice Maule said he did not think he could make any order , until be had heard what the prisoners referred to had to say upon the subject ; and therefore the motion must stand over for the present . Henry Harris , 27 , was charged with having , on the 24 th of July , at the parish of Linthorpe , in the North Riding , feloniously assaulted Eliza Richards , and committed a rape on her person . John Whitehead , 31 waa charged with having , on the 5 th of July , assaulted Mary Riley with intent to commit a rape . —To bo imprisoned six msnths . William Fairclough , 22 , pleaded guilty to having , at Emley , in the West Riding , feloniously assaulted Wm . Dyson , and robbed him of eight shillings , and a pair of spectacles , and two memorandum books . —To be tran » ported fifteen years .

J PROPOSED SPECIAL COMMISSION . This morning the Hou . J . S . WoRlLEY , resumed his application for ao jiurning the trial of one hundred aud two p : isoners confined iu York castle on charges of riot His Lordship had received au amended affidavit , containing the names of the prisoners to which SUis application extended , but he was not able to carry the statements further than in the affidavit he made yesterday . Notice had bsen given to all the prisoners , by reading it over to them , of the nature of this application , and therefore they had an opportunity of oppesing it .
Mr . Newton said he was instructed by three prisoners , Rushworth , Brook , and Gibbons , t « oppose this application . Ee cemplained that such a surveillance bad bten kept up in the ^ aol that free access could not bo had with the ptisonere , for the purpose of preparing their defence . He trusted therefore that hla Lordship would not make this order peremptory , but grant a rule nisi that they might hare an opportunity of obtaining a copy of Mr . Jlaule ' a affidavit and of answering it . His clients were anxious to take their trials forthwith . Mr . Worilev said , that his application did not apply to any of the prisoners for whom Mr . Newton appeared .
Mr . Justice Ma » lb . —In all doabtful cases , beyond doubt , the proper course was to grant a rule nisi . He hid considered tbia application and the afildavlt on which it was made . He bad taken an opportunity of consulting with Lord Denman , and upon a full con-• ideration be bad come to a conclusion , in which he had the authority of Lord Denman for stating that bis Lordship fully concurred , that tbi * affidavit did not mfc oat sufficient grounds for granting so general an application—and therefore , acting with the foil concurrence of Lord Denman , he ref ued the application . Ann Greentrood , 25 , waa charged with the murder of Emily Greenwood , her daughter , by suffocating her in a privy . Tbe evidence failed in bringing home the charge agaiDst the prisoner , and the Jury consequently brought in a verdict of Not Guilty .
John Lodge , 21 , was charged with havtog on the 20 th of Oetober last , at Darfleld , committed perjury in tbe testimony he gave on an inquisition taken before Thomas Badger , Esq ., coroner , touching the death of Thomas Depledge . Guilty . Mr . Bliss took some objections to the verdict , which were overruied ; but the Judge sajd , aa the prisoner had been connned eince the 13 th of March , he ' should discharge him . t

H ' tftiam Boulton , 27 , was charged with having on the ldihoi May last , at Kirk Smeaton , feloniously stolen one lamb , the property of Thomas Boulton . Guilty . To be imprisoned 12 calendar months , the last week in solitary confinement . James Wagden , 45 , Henry Wagdcn \ 5 , and Mary Ann Arrawsmith , 20 , were charged with having , on the 9 th of July last , at Almondbury , near Huddersfield , feloniously stolen a cow , the property of Mary Whitehead .
The Jury not being able to agree on their verdict , retired to consult , and on their return they found the male prisoners Guilty , and acquitted the female . James Wagdon to be imprisoned twelve months , and Henry Wagden for three months , the last week in solitary confinement . Robert Quar , 27 , was charged with having , on tho 25 ; h of May last , at Lseds , feloniously stolen a cow , the property of Michael Houghton . Guilty . To be imprisoned twelve calendar months , tne last week in solitary confinement .

James HoKorth 40 , was charged with haviug feloniously received a leg of mutton , 41 bs . weight of bog ' s lard , a flitch of bacon , aud some eggs , the property of William Ferguson Holroyd . Mot Guiity . Joseph / lardman 27 , was charged with having burglariously entered tho dwelling-house of Samuel Lees , and stolen aa iroa-bar therefrom . Gailty . Seuter . ce deferred .
John Welsh 13 , Henry . Bradley 11 , and Cornelius Welsh 14 , were charged with having , at Holmcupon Snalding Moor , stolen a coat , the property of Robert Hill . Tho prisoners John Welsh and Henry Bradley pleaded Guilty ; the other boy vra 8 deaf and dumb , no evidence was offered against him , and he was acquitted . Tho other prisoners were each sentenced to be imprisoned for twelve mouths to hard lrbour , tho last week in solitary confinement . Tho Court adjourned at six o ' clock .

George Bonct , 19 , was charged with , having , on tho 25 h of June last , at Hmderwcli , feloniously embezzled four shillings and tenpenu 8 , tho property of Georgo Moon , iiis master . To be imprisoned for six calendar mouths to hard labour—The first and last week in solitary confinement . Henry Redman Baker , . ' 57 , was charged with having burglarioiu-ly broken and catered the dwelling-house of Joseph Webb , with intent to steal therefrom . The Jury , after a short consultation , f .. und the prisoner Guilty , and ho was transported for ten years .
Henry Mitchell , 18 , was charged with having at Bingley , feloniously stolen one filly and a saddle , the property of I . ' -aac Doughty . The prisoner was sentonced to bo imprisoned for six calendar months to hard labour , tho firss and last weeks in solitary confinement , lio applied to the Court to send him out of the country , —a request which Mr . Sergeant Murphy declined to accede to , and warned the prisoner as to his futuro conduct , as should he again be found gnilty of any offence he would undergo the horrors of transportation , which he would deplore to the end of his life .
Samuel Blackburn , 61 , was charged with having feloniously uttered a certain bill , indorsed " March 7 , settled W . Scott , 1828 " with intend to defraud William Scott , he well knowing the same to be forged . Tho Jury found the prisoner Guilty of uttering . Christiana Blackburn , 29 , was then charged with having committed wilful and corrupt perjury , —iu having sworn that she saw her . falher pay to Mr . Scott , surgeon , of Sherburn , a sum of £ 12 10 s . for which sum Mr . Scott had brought an action against her father , in tho Barkstone Court of Requests , and that she witnessed Mr . Scott sign a receipt for tho same . Guilty . Wednesday aug . 24 .
Jane Elhvood , , was charged with having , at Knaresborough , on the 23 d of May last , feloniously and unlawfully endeavoured to conceal the birth of a child by throwing it into the river Nidd . George Bentlcy 25 , and William Hair , 27 , were charged with having ,. at Cottingham , feloniously assaulted Joku George Lee aud Btolen frora hid person six shillings , a penknife , and a small paper box containing steel pens , his property . —Guilty—To be transported for fifteen years . Thomas Abel , 23 , was charged with having at Leeds , on the 19 th of March last , feloniously assaulted Samuel Keeble , and stolen from his person , four half crowns , two shillings and one sixpence , two steel keys and a canvass puree , bis property .
The prosecutor is coachman td Mr . Brooke , Burgeon , of Leeds , but does not reside in that gentleman ' s house , but in Church-lane , in ttut town . On the 19 th of March , his master paid him six half-crowns for some account outstanding between them . At night , prosecutor went to his o \ ub , and there paid one shilling , and when within a few yards of hia own door three men sprung on him from a stable , and after abusing him , robbed him of all his money and somo other things .
The prosecutor distinctly saw two of the men , one was the prisoner , and the other was called Fothergill , and bad , on the prosecutor's description , been apprehended . He was tried and convicted of tbe robbery at the Leeds quarter sessions . The proBecutor gave a description of the prisoner , but he had absconded , and was not apprehended until about a month after . The prosecutor picked him out Of a number of men who were shown to him in the prison yard at Leeds . —Guilty . —To be imprisoned one year to hard labour .
Thursday , August 25 . Chrisliuna Blackburn was this morning brought up for judgment , when Mr . Sarjeant Murphy said that he had referred the point set up by the Counsel , Mr . Piishley , to the Lord Chief Justice Dsnman and Mr . Justice Maule , and the opinion they had expressed was that there was default in the trial , consequently , the sentence of the Court was that the prisoner should pay a flue of Is . to the Queen and be imprisoned for twelve ca ' . endar months . Thomas Cookson , 20 , was charged by the Coroner's inquisition with tae manslaughter of William Sykes , at Halifax . Not Guilty .
William Rawdin , 34 , was charged with having on the 3 rd July last , at Barnsley , burglariously broken and entered the warehouse of Elizabeth Armitage , with intent to steal therefrom . Guilty . To be transported for ten years . William Franklcton , 63 , waa charged with having , in March last , at Halifax , feloniously received 8 lbs . weight of bacon , the property of Edward Fayrer , well knowing tho same to have been stolen . Not Guilty . Thomas Rawcliffe , 30 , was charged with having , in February last , at Halifax , feloniously received ona pair cf shoes , the property of John Crosslond , well knowing them to have been stolen . Not Guilty .
Richard Wilkinson , 61 , was charged with having , on tbe 22 d of January last , at the borough of L 9 eds , feloniously forged and uttered a certain warrant for the payment of money , with intent to defraud one Thomas Robinson . The Jury found the prisoner Guilty of uttering , but recommended him to mercy , which recommendation was acceded to by the prosecutor . The prisoner was sentenced to a fortnight ' s imprisonment , commencing from the opening of the assizes . Charles Gillait , who had been out on bail , was charged with having , on the 14 th of June last , at Sheffield , stolen from the person of Joseph Newbald , a coat , waistcoat , handkerchief , and pair ef boots , his property . Verdict , Not Guilty .
Friday , Augwst 26 . Thomas Luplon , who had bsen on bail , was indicted for stealing at Bradford , on the 11 th of July last , a promissory note for £ 10 , the property of Thomas Steel . Guilty . To be imprisoned twelve calendar monthB to bard labour . Edward Emmolt , 24 , was charged with having on the 30 th of April last , at Leeds , feloniously assaulted Joseph Glover , and stolen from his person 13 s . in silver , 6 lbs . of mutton , and other articles . Guilty . To be transported fifteen years .
